3. AI, Phone Calls, and Automated Technologies

KD3 Digital LLC uses artificial intelligence technologies, automation tools, chatbots, AI voice assistants, and conversational AI systems to assist with:

  • Answering phone calls and chats
  • Customer support
  • Appointment scheduling
  • Lead qualification

  • Communications and follow-up

When you call a KD3 Digital phone number or use our demonstration lines, your call may be answered by an AI voice assistant, and the call may be recorded and transcribed for quality, training, scheduling, and record-keeping purposes. Information submitted through these systems may be processed by third-party technology providers acting on our behalf. Please do not submit highly sensitive personal information, such as financial account numbers, government identification numbers, or health information, through these systems unless we specifically request it.

4. Text Messaging (SMS) Program

If you provide your mobile number and check the box agreeing to receive text messages from KD3 Digital, we may send you text messages related to appointment scheduling, confirmations, and reminders; responses to your inquiries; customer support; and account or service notifications. If you separately agree to receive marketing text messages, we may also send offers, event invitations, and updates about our content and services. Consent to receive text messages is not a condition of purchasing any goods or services.

  • Message frequency varies based on your interactions with us.
  • Message and data rates may apply.
  • To opt out, reply STOP to any message. You will receive one final message confirming that you have been unsubscribed, and no further messages will be sent unless you opt in again.
  • For help, reply HELP or contact us at [email protected].

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service or the messaging platform that delivers our texts, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. We do not sell, rent, or share mobile opt-in data or SMS consent with third parties, affiliates, or lead generators.

For full program details, see the Text Messaging (SMS) Terms section of our Terms & Conditions.

5. Cookies and Tracking Technologies

We may use:

  • Cookies
  • Pixels
  • Tags
  • Analytics tools
  • Session tracking technologies

These technologies help us:

  • Understand user behavior
  • Improve website performance
  • Measure marketing effectiveness
  • Personalize user experiences

You may disable cookies through your browser settings, though certain features of our websites may not function properly.

Analytics and advertising tools. Our websites use the tracking built into our website and customer relationship management platform to understand how visitors use our pages. We may also use Google Analytics to measure website traffic and the Meta Pixel to measure our advertising and show ads to people who have visited our websites. These providers may set their own cookies and collect information about your activity on our websites and across other websites over time. To learn how Google uses this information, visit www.google.com/policies/privacy/partners. You can opt out of Google Analytics with the Google Analytics Opt-out Browser Add-on, and you can manage the ads you see on Facebook and Instagram through your Meta ad preferences. We do not send mobile phone numbers to advertising platforms through these tools.

Affiliate links. Some links on our websites are affiliate links. When you click one, the company we link to may place a cookie on your browser to track whether a purchase came through our link. That company's privacy policy governs the information it collects.

Do Not Track signals. Some browsers offer a "Do Not Track" setting. Because there is no common industry standard for responding to these signals, our websites do not currently respond to them. The third-party analytics and advertising providers described above may collect information about your online activities over time and across different websites.

Social media. Our websites may link to our profiles on social media platforms such as LinkedIn and Facebook. If you contact us through a social media platform, we receive the information you choose to share with us there. When you visit those platforms, their own privacy policies apply.

6. Third-Party Service Providers

We may use third-party service providers to operate portions of our business, including:

  • Website hosting providers
  • Payment processors
  • Customer relationship management (CRM) systems
  • Scheduling software
  • Email and text messaging platforms
  • Telephone and voice service providers
  • Analytics providers
  • Artificial intelligence platforms
  • Advertising and remarketing platforms

These providers may access information only as necessary to perform services on our behalf. Mobile phone numbers and SMS opt-in data are never provided to advertising, remarketing, or other third parties for their marketing purposes, as described in Section 4.

7. Payment Information

If payments are processed through our websites, transactions may be handled by third-party payment processors. KD3 Digital LLC does not store complete payment card information on its servers. Payment information is subject to the privacy and security practices of the applicable payment processor.

8. Marketing Communications

If you provide your contact information and agree to receive marketing communications, we may send:

  • Newsletters
  • Service updates
  • Marketing communications
  • Educational content
  • Event invitations
  • Promotional offers

You may unsubscribe from marketing emails at any time by clicking the unsubscribe link in any email or by contacting us directly. You may opt out of text messages at any time by replying STOP. Opting out of marketing messages will not stop administrative or transactional messages related to services you have requested, unless you opt out of those as well.

9. Data Sharing

We do not sell your personal information.

We may share information:

  • With service providers assisting our operations
  • With professional advisors
  • To comply with legal obligations
  • To protect our rights, property, or safety
  • In connection with a merger, acquisition, or business transfer

None of the categories above include text messaging originator opt-in data and consent, which is never shared with third parties as described in Section 4.

10. Data Security

We implement commercially reasonable safeguards designed to protect personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the Internet or electronic storage system can be guaranteed to be completely secure.

11. Data Retention

We retain personal information only as long as necessary to:

  • Fulfill the purposes outlined in this policy
  • Maintain records of consent and opt-out requests
  • Comply with legal obligations
  • Resolve disputes
  • Enforce agreements

12. Your Privacy Rights

Depending on your location, you may have rights regarding your personal information, including:

  • Access
  • Correction
  • Deletion
  • Restriction of processing
  • Data portability
  • Withdrawal of consent

To exercise these rights, contact us at [email protected]. We will respond within a reasonable time and may need to verify your identity before fulfilling your request.

13. Children's Privacy

Our websites and services are intended for adults and are not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 13. If we become aware that such information has been collected, we will take appropriate steps to delete it.

14. External Links

Our websites may contain links to third-party websites. We are not responsible for the privacy practices or content of external websites. Users should review the privacy policies of any third-party sites they visit.

15. Client Data

When KD3 Digital builds or manages AI receptionists, automations, or messaging systems for our business clients, we process information about our clients' customers on our clients' behalf and according to their instructions. In those cases, the client's own privacy policy governs how that information is used, and questions should be directed to that business.

16. Changes to This Privacy Policy

We may update this Privacy Policy periodically. Any changes will be posted on this page with an updated date. Continued use of our websites after changes are posted constitutes acceptance of the revised policy.
